Gamers Net NZ Game Server Terms and Conditions.

Gamers.Net Gaming Servers (hereby known as Gamers) provides the following guidelines for game server rental.

Rental

The minimum rental period is 1 calendar month and the rental fee is non-refundable. Your credit card will be billed for the initial months payment unless Direct Debit is selected.

When your server has been paid for in full, we are notified to fulfill your order. Your rental period will not start until the day we give you access to your server. The current average waiting period is 24 hours from completion of your order.

Your server if ordered during the week should be provisioned within 24 hours (Monday - Friday 6pm).  Orders after this time will take up to 48 hours to install.  Custom configurations that are non standard installs that we have to manually create may take up to 5 days to install.

Server

In the context of this document 'server' means single game process.

Users are permitted to run one game process on their server. Gamers will include the necessary files for the chosen games upon completion of the clan rental form. The user is responsible for ensuring that they have permission to use any mods or maps used on their server.

The user is responsible for uploading any updated maps, mod’s and the like to their server. In special circumstances Gamers will help, for example with new releases of large files, but the day to day management is down to the user.

The server may not be used for commercial purposes, or financial gain.  Onselling Gamers services without permission will result in immediate suspension of all services.  The server may not be named offensively or in a way to reflect a commercial organization, except with the express permission of Gamers.

You may not increase the player limits on your server (this includes spectators) without the prior permission of Gamers and payment of the difference in rental prices. We are unable to offer refunds to clans who wish to reduce player numbers for any reason.

The gaming server is for the sole purpose of hosting a game process. It may not be used to host files, downloads or the like, this includes the uploading of any files, images or software not directly associated with the running of the game process. Any such abuse of the server will result in service being suspended and the forfeiture of outstanding rental payments.

Faults, Downtime and Errors

The User accepts that there may occasionally be problems with computers and telecommunication systems. Consequently the User accepts that there may be periods of downtime, relating to the Services and/or Web Site, in which the User cannot access these. However, Gamers Net NZ will maintain reasonable effort to minimize these periods. The User accepts that in such cases of downtime, they will have no claim of breach of contract. When possible Gamers Net NZ will notify the User of predicted downtime and/or scheduled downtime for upgrades, updates, etc.

Naming Convention / Logo

All servers must conform to the Gamers naming convention unless the  Private option has been purchased. Therefore your server name will include Gamers Net NZ and your clan name unless you pay for a non sponsored server, in which case there are no such restrictions

In addition to adhering to  Gamers Net NZ  standard naming convention clans will also include a 88x31 'Gamers.Net' link button
(linking back to http://www.gamers.net.nz) on their clan homepage (irrespective of whether or not they have chosen the non sponsored option). This is non negotiable, do not rent one of our servers if you have an issue with including our button on your site.

All sponsored servers are required to have specific text within the MOTD, and/or advertising placements within the game (with supported games). 

Server Inspections

Gamers Net NZ reserves the right to inspect the customer’s services at any time to ensure they are in accordance to the terms of service agreement outlined here.

Issues / Configuration issues

All servers are installed with a default ‘out of the box’ configuration, as would be supplied by the game publisher to enable the server to work as a standalone game server.  Gamers while providing these game servers, will deal with issues on the default install only.  Any issues caused by mods/addons/mutators are the sole responsibility of the clan. 

If issues cannot be solved by the clan Gamers will repair the server back to a default install.  (See Reinstallation)

Gamers will assist with any problems, but we will NOT configure your server, or install modifications for you.  You have to have a level of competency in order to configure and get your server running correctly.  Please make sure you have this knowledge before you make an order with us.

Cancellation / Reinstallation

Clans must give 14 days notice of wish to discontinue a server rental.    Clans are able to have their game server installed back to default configuration once (1)  per calendar month.  If you do not give us 14 days notice, your next months payment will be forfeit if paid by subscription.

Payment / Default on Payment

Payment is required in advance for any services, before your server will be installed.  Your next payment will be due one (1) calendar month after your server has been installed.  You will be notified of this 5, 4, 3, 2 and 1 day before your bill is due.  Your server will be suspended three (3) days after the bill date falls due. 

Should you wish you server reinstated, this will incur a $10 charge if your server has not been paid for within 5 days of due date.

Your account will be deleted 14 days after non payment of your account. 

It is your reponsibility to cancel subscriptions via PayPal, as we have no access to do this.  If a payment has been marked as completed it will NOT be refunded.

Refunds

Once payment has been received for a service hosted by Gamers Net NZ payment is non refundable or transferable unless otherwise agreed by Gamers Net NZ.
